GEMMA-IO TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

Welcome to GEMMA-IO ("App"), an AI-powered hairstyling assistant developed by Bluesky Technologies Company By downloading, accessing, or using GEMMA-IO, you agree to be bound by these Terms and Conditions . If you do not agree to these Terms, you must immediately cease using and uninstall the App.

2. ELIGIBILITY

You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use GEMMA-IO. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have read and agreed to these Terms on your behalf. Use by anyone under 13 is strictly prohibited.

3. LICENSE AND USE

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use GEMMA-IO for personal, non-commercial purposes on devices you own or control.

3.2 Restrictions

You agree NOT to:

• Modify, copy, reverse engineer, or create derivative works of the App.
• Use the App for any illegal, fraudulent, or unauthorized purpose.
• Attempt to extract the source code of the App.
• Use the App to harass, harm, or impersonate others.
• Use automated systems (bots, scrapers) to interact with the App.

4. PRIVACY AND DATA CONSENT

Your use of GEMMA-IO is governed by our Privacy & Consent Statement, which is incorporated into these Terms by reference. You explicitly consent to the processing of your image and facial data as described therein. The AI-generated hairstyle previews are for entertainment and inspiration purposes only and do not guarantee actual results.

5. INTELLECTUAL PROPERTY

5.1 Our Ownership

GEMMA-IO, including its AI models, software, designs, graphics, "look and feel," trademarks, and all content (excluding User Content), is the exclusive property of the Company or its licensors and is protected by copyright and intellectual property laws.

5.2 User Content

"User Content" refers to photos you upload or capture within the App for virtual try-on. You retain ownership of your original User Content. By uploading it, you grant us a limited, worldwide, royalty-free license to process, analyze, and temporarily store that content solely to provide the App's hairstyling features, as detailed in our Privacy Statement. This license terminates when you delete the content from our systems.

5.3 AI Outputs

The virtual hairstyle simulations generated by the AI ("Outputs") are based on your input and our proprietary models. You may use these Outputs for personal purposes. However, the underlying technology, algorithms, and designs remain our intellectual property.

6. DISCLAIMERS AND LIMITATION OF LIABILITY

6.1 "As Is" Service

GEMMA-IO IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE AI PREVIEWS ARE ACCURATE OR ACHIEVABLE.

6.2 No Professional Advice

THE APP PROVIDES ENTERTAINMENT AND INSPIRATIONAL VISUALIZATIONS ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE FROM A LICENSED HAIRSTYLIST, DERMATOLOGIST, OR OTHER PROFESSIONAL. ACTUAL HAIRSTYLES, COLORS, AND PRODUCT RESULTS MAY VARY BASED ON HAIR TYPE, CONDITION, AND PROFESSIONAL APPLICATION. YOU ASSUME ALL RISK ASSOCIATED WITH ANY HAIRSTYLING DECISIONS YOU MAKE.

6.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY, ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DISSATISFACTION WITH A HAIRSTYLE, DATA LOSS, OR ANY DECISION MADE BASED ON AN AI PREVIEW. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST 12 MONTHS, OR $10, WHICHEVER IS GREATER.

7. USER CONDUCT AND RESPONSIBILITIES

You are solely responsible for:

• The content you upload (you warrant it is yours and does not violate any third-party rights).
• Your interactions with the App.
• Any decisions or actions you take based on the App's suggestions.
• Maintaining the confidentiality of your account (if applicable).

You agree not to upload content that is illegal, obscene, defamatory, threatening, or infringing on intellectual property rights.

8. SUBSCRIPTIONS AND PAYMENTS (If Applicable)

8.1 Subscription Terms

GEMMA-IO may offer premium features via subscription. If you purchase a subscription:

• Payment will be charged to your app store account at confirmation.
• Subscriptions auto-renew unless turned off at least 24 hours before the current period ends.
• You can manage subscriptions and turn off auto-renewal in your device's app store account settings.
• No refunds are provided for unused portions of a subscription period, except as required by law.

9. TERMINATION

We may terminate or suspend your access to GEMMA-IO immediately, without prior notice, for any breach of these Terms. Upon termination, your license to use the App ceases, and you must uninstall it. All provisions which by their nature should survive termination shall do so.

10. MODIFICATIONS

We reserve the right to modify, update, or discontinue GEMMA-IO or these Terms at any time. We will provide notice of material changes within the App or via email. Your continued use after such changes constitutes acceptance of the new Terms.

11. THIRD-PARTY SERVICES AND LINKS

The App may contain links to third-party websites, products, or services (e.g., hair product retailers). We are not responsible for the content, privacy policies, or practices of any third party. Any transactions or engagements are solely between you and the third party.

12. GOVERNING LAW AND DISPUTE RESOLUTION

14. ENTIRE AGREEMENT

These Terms, together with the Privacy & Consent Statement, constitute the entire agreement between you and the Company regarding GEMMA-IO and supersede any prior agreements.
